1. Introduction
These Terms and Conditions (“Terms”) govern the use of the services provided by GSM Brokers (“we,” “our,” “us”). By using our platform or services, companies (“Clients”) acknowledge and agree to these Terms in full. All relationships are strictly business-to-business (B2B) and intended for professional entities such as resellers, traders, or companies operating within the GSM sector.
2. Scope and Role
GSM Brokers operates as an independent intermediary and consultant, coordinating communication and commercial activity within its network of trusted partners. This network includes warehouses and distribution partners that make stock available through GSM Brokers, clients and resellers who purchase such goods, and technical or logistics partners that may provide complementary services such as transport, inspection, or repairs. GSM Brokers facilitates and supervises the business process between these entities but does not take ownership, possession, or direct control of the goods or services exchanged.
3. Order Process
Offers shared by GSM Brokers are based on stock availability from its partner warehouses.
When a Client confirms an order, GSM Brokers communicates the details to the relevant partner for execution. The partner warehouse is responsible for invoicing, payment collection, and shipment directly to the Client. GSM Brokers’ role is limited to coordination, verification, and support during the transaction.
4. Invoicing and Delivery
All products are invoiced and dispatched directly by the relevant warehouse or partner.
GSM Brokers does not issue sales invoices for the goods, does not handle payments on behalf of partners, and does not store or ship products. Once goods are dispatched, all responsibility for delivery, timing, and condition rests with the warehouse or its appointed courier.
5. After-Sales
Each warehouse operates according to its own internal policies for returns, replacements, and credit notes. Clients are required to follow the procedures established by the specific partner warehouse from which the goods were sourced. GSM Brokers may assist in facilitating communication or clarifying processes but bears no responsibility for the timing, approval, or outcome of any after-sales decisions made by partner warehouses.
6. Extended Repair Service
GSM Brokers offers an Extended Repair Service, an optional paid repair program designed to simplify post-sale technical management for Clients. The service can be activated for devices purchased through GSM Brokers’ network or from other verified sources.
6.1 Nature of the Service
The Extended Repair Service is a technical repair service, not an insurance plan. Repairs and diagnostics are performed exclusively by authorized partner service centers, selected by GSM Brokers for quality and reliability. GSM Brokers does not carry out physical repairs; it coordinates the process between the Client and the service center.
6.2 Eligibility and Documentation
The Extended Repair Service is available exclusively for Apple iPhone devices. All other products, including tablets, smartwatches, accessories, and consumables (such as chargers, cables, cases, screen protectors, SIM cards, modems, and similar items), are excluded. The Client must upload the purchase invoice covering the iPhones to be included. The Extended Repair Service must be purchased for all iPhones listed on that invoice; partial coverage of individual items within the same invoice is not permitted. IMEI numbers are not required at registration. GSM Brokers may verify the authenticity and details of the uploaded invoice directly with the issuer or through verification partners and may refuse or cancel activation if the invoice cannot be verified or if eligibility conditions are not met.
6.3 Activation
The service becomes active upon online acceptance of these Terms and successful payment. The coverage period begins from the purchase date shown on the uploaded invoice, provided the Extended Assistance is purchased within 48 hours of that date.
6.4 Coverage and Duration
The service applies exclusively to technical or mechanical issues and does not cover damage arising from misuse, physical damage, or unauthorized modifications. The term is 3, 6, or 12 months, depending on the selected plan, and runs from the purchase date shown on the uploaded invoice (as per Clause 6.3). The Extended Assistance period is single and continuous from the invoice purchase date. For the standard coverage period provided by the selling warehouse on the original invoice (e.g., 14, 28, or 30 days, as specified by the seller), the seller’s coverage takes priority and requests must follow the seller’s procedures. During that period, GSM Brokers will provide the Client, free of charge, with a shipping label to return the device to the seller or to the authorized service center designated by the seller. Upon expiry of that period, and until the end of the selected plan term (3, 6, or 12 months), requests will be handled under the Extended Repair Service, as set out in Clauses 6.6 to 6.13. Where the seller provides no standard coverage, the Extended Repair Service cannot be purchased or activated.
6.5 Fraud and Misuse
Any attempt to submit false documentation, manipulate product identifiers, or request assistance for goods not matching the declared purchase will be treated as fraudulent behavior. GSM Brokers reserves the right to immediately terminate the service, block the Client from its network, and inform relevant partners or authorities.
6.6 Responsibility
All technical interventions are the exclusive responsibility of the appointed service partner. GSM Brokers’ role is limited to coordination and supervision of the communication flow. Clients are responsible for backing up all data before sending devices; GSM Brokers and its partners assume no liability for data loss.
6.7 Assistance Procedure
The Client must submit the fault through the online form available on the GSM Brokers website.
The Client must wait for shipping instructions and send the device to the address indicated by GSM Brokers or the appointed service partner.
The Client must package the device properly and perform a full data backup before shipment.
The Client must disable any locks or security features (for example, “Find My iPhone”) prior to shipment.
No replacement devices are provided during the repair period.
6.8 Repair Timeline and Substitution
Repairs are typically completed within 4-5 business days from receipt by the appointed service partner; this timeframe is indicative and non-binding.
6.9 Service Exclusions
The Extended Repair Service does not apply to:
damage caused by impact, drops, liquids, humidity, or improper use;
normal wear and tear (including battery degradation);
software issues, iCloud locks, viruses, or similar;
prior unauthorized repairs, tampering, or altered identifiers.
6.10 Out-of-Scope Notification
If, upon inspection, the reported issue is determined to fall outside the scope of the Extended Repair Service (for example liquid damage, impact or pressure damage, signs of tampering or unauthorized repair, software or activation locks), GSM Brokers or the appointed service partner will notify the Client within five (5) business days from receipt of the device. The notice will indicate:
(a) the reason the issue is out of scope;
(b) any available options such as a paid repair or return of the device; and
(c) the procedure and timelines for return.
In these cases the device will be returned unrepaired unless the Client expressly accepts, subject to the partner’s policy and availability, a paid repair or another alternative solution.
6.11 Shipping and Risk
Unless otherwise agreed in writing, the Client bears the cost of shipping devices to and from the appointed service partner. Risk of loss or damage in transit remains with the Client; any claims must be made directly with the courier.
6.12 Diagnostic and Handling
For out-of-scope cases (see 6.10), diagnostic, handling, and return-shipping costs may be charged to the Client. If the Client does not provide written instructions within seven (7) business days from the out-of-scope notice, the device will be returned unrepaired and applicable costs will be invoiced.
7. Logistics Services
GSM Brokers may also provide, upon Client request, an optional logistics service available for purchase directly on the website, consisting solely of the issuance of a shipping label for sending devices for assistance or inspection. The label is issued through couriers such as UPS or DHL at the discounted rate of €2.50 per device, with a minimum charge of €10.00 per label.
For certain destinations or specific countries, the cost of the label may be slightly higher, depending on the courier’s applicable tariffs. Shipments are governed exclusively by the standard terms and conditions of the courier.
8. Limitation of Liability
8.1 Scope and general limitations
GSM Brokers’ involvement is limited to mediation and coordination within its professional network. GSM Brokers is not liable for product defects, delivery delays, or non-performance by warehouses, carriers, or technical partners. In no event shall GSM Brokers be liable for indirect, incidental, or consequential damages, including loss of revenue, opportunity, or data.
8.2 Transport and logistics services
Issuance of a shipping label by GSM Brokers does not create any obligations as a carrier, freight forwarder, or agent. Shipments are governed exclusively by the terms and conditions of the carrier used, for example UPS or DHL. Risk of loss, theft, damage, or delay in transit remains with the Client; any claims must be addressed exclusively to the carrier. The applicable insurance coverage, where provided under the carrier’s terms, is the carrier’s standard coverage; otherwise, no coverage applies. Any additional insurance is the Client’s responsibility and must be arranged directly with the carrier. GSM Brokers does not provide, advise on, or intermediate insurance coverage. The foregoing also applies to shipments carried out in connection with the assistance service, see Clauses 6.7 to 6.13.
8.3 Liability cap
Any liability of GSM Brokers shall, in any event, be limited to the total amount paid by the Client to GSM Brokers for the service directly related to the claim.
9. Compliance and Verification
Information provided by GSM Brokers regarding warehouses, stock, or services is offered for reference only. Clients are responsible for conducting independent verification and ensuring that all transactions comply with applicable laws, import/export requirements, and fiscal regulations in their own jurisdiction.
10. Dispute Resolution
Any dispute relating to the sale of goods or provision of services must be addressed directly between the Client and the relevant warehouse or partner. GSM Brokers may assist in mediation when possible but cannot be held responsible for any party’s contractual or operational obligations.
11. Amendments
GSM Brokers reserves the right to amend these Terms at any time. Updates will be communicated to Clients and published on the official website. Continued use of GSM Brokers’ services constitutes acceptance of the revised Terms.
12. Governing Law and Jurisdiction
These Terms are governed by Italian law. For any dispute relating to interpretation or execution, the Court of Isernia (Italy) shall have exclusive jurisdiction.
13. Acknowledgment
By using GSM Brokers’ services or activating the Extended Repair Service, the Client acknowledges that they have read, understood, and accepted these Terms and Conditions in full.
14. Data Protection and Confidentiality
GSM Brokers processes Client data in compliance with Regulation (EU) 2016/679 (GDPR) and applicable laws. The full privacy notice is available at www.gsmbrokers.com/privacy-policy. Personal and device information is used solely for operating the Extended Repair Service and coordinating with appointed partners. GSM Brokers and its partners will keep such information confidential and will not copy or retain data beyond what is necessary to perform the service and comply with legal obligations.
