1. Introduction
These terms and conditions apply to the use of GSM Brokers’s services.
2. Role of GSM Brokers
GSM Brokers serves as a consultant and an intermediary, facilitating the transaction and communication between Clients and Suppliers but does not engage in the direct sale, purchase, or storage of goods.
3. Inventory and Stock Ownership
All products are owned, invoiced, and dispatched by the Suppliers directly to the Clients.
4. Order Process
Clients will receive offers from GSM Brokers. Upon acceptance, orders are communicated to and fulfilled by the Suppliers.
5. Invoicing and Shipping
Suppliers are responsible for invoicing and shipping the products directly to the Clients.
6. Warranty
Standard Warranty: The standard 30-day warranty covers any defects detected from the date of purchase, excluding accidental damage, variations in battery percentage detected with software other than NSYS, slight halos visible in photos taken with the camera against a white background (only for A/B and B/C grades), software issues, water damage, tampering, etc… Clients must use the specific RMA form available on the GSM Brokers website to initiate the warranty process. Once the faulty unit, complete with the completed RMA form, is received, the device will undergo inspection, testing, and, if necessary, will be repaired or replaced using both original and compatible parts. The entire process will be completed within approximately 10 working days.
Extended Warranty: It is possible to extend the standard 30-day warranty to a variable period between 90 and 180 days for an additional cost, as detailed in our price list. This extension is available only for devices classified as USED A, USED A/B, and USED B/C. The extended warranty does not cover damage caused by drops, impacts, excessive pressure, or other physical stress that can compromise the integrity of the device is excluded from the warranty. This includes, but is not limited to:
Logic board damage such as detached solder joints of components, fractures or cracks in the printed circuit boards (PCBs), or any other circuit damage caused by physical stress. Even if the device shows no visible signs of a drop, technical diagnostics may reveal internal damage resulting from impacts or stress.
Damage to internal components such as connectors, circuits, memory modules, and other critical elements caused by tampering, impacts, or abnormal flexing.
Structural damage to the Frame or Housing that may affect the functionality and internal protection of the components.
Damage resulting from accidents, such as drops, liquid contact, exposure to extreme environmental conditions (excessively high or low temperatures, high humidity), or damage caused by external agents such as dust and sand.
The extended warranty does not cover defects related to the battery, camera, display, face ID, iCloud and SIM lock which maintain a limited warranty period of 30 days from the date of invoicing.
Standard RMA: Clients must request a Return Merchandise Authorization (RMA) within 30 days of receiving a defective device. The Client must provide the device model, storage capacity, grade, color, IMEI number, and a detailed description of the issue. Once approved, the Client will receive instructions for returning the device to the Supplier. Clients are responsible for all shipping and insurance costs when returning defective devices. The Supplier will cover the shipping costs of sending the replacement back to the Client.
Free RMA: Clients may opt for an RMA pickup service at an additional cost. If purchased and a defective device is reported within 30 days, GSM Brokers will provide a prepaid shipping label to return the product to the Supplier. Clients are responsible to insure the parcel if they wish to. Once the product is handed to the courier, GSM Brokers assumes no further responsibility for loss, damage, or delays during transportation; any claims must be made directly with the courier.
Refunds: No refunds are provided for faulty products. If a replacement is not available, a credit note will be issued for the next purchase.
Reporting Period: Any discrepancies related to the aesthetic grade or battery percentage must be reported within 5 days of receipt of the goods; otherwise, they will not be considered under the warranty. If a Client has requested batteries with a specific higher percentage and receives standard batteries instead, we will only issue a credit for the price difference. RMAs will only be accepted for devices where the battery capacity is below 80%. We do not accept RMAs for incorrect colours received, as we do not guarantee color preferences.
7. Supplier Verification and Compliance
While GSM Brokers may provide information about Suppliers, we do not provide legal, tax, or professional advice. Any information provided is for general informational purposes only and should not be considered a substitute for independent verification. Clients are solely responsible for conducting their own due diligence regarding Suppliers to ensure that transactions meet their specific requirements and comply with all applicable laws and regulations. Clients are encouraged to consult their own legal, tax, and professional advisors.
8. Limitation of Liability
GSM Brokers acts solely as an intermediary between Clients and Suppliers. All transactions including sale, purchase, invoicing, shipping, RMAs, and payment, are conducted directly between them. GSM Brokers is not a party to any transaction and assumes no liability for any aspect of the transactions or the products and services provided by Suppliers.
We make no representations or warranties, express or implied, regarding Suppliers or their products and services. Clients acknowledge that transactions are made directly with Suppliers at their own risk.
Under no circumstances shall GSM Brokers be liable for direct, indirect, incidental, consequential, or special damages arising from the use of our services or transactions between Clients and Suppliers
9. Dispute Resolution
Any disputes arising from transactions facilitated by GSM Brokers shall be resolved directly between the Client and the Supplier, with GSM Brokers providing support in mediation if required.
10. Amendments
GSM Brokers reserves the right to update these terms and conditions with due notification to Clients.
11. Governing Law
These terms are governed by the laws of the Country/State of the respective Suppliers and any disputes will be subject to the exclusive jurisdiction of those courts.
12. Acknowledgment
By using GSM Brokers’s services, the Client agrees to the above terms and conditions.
